Issue:

Based on interview and record review, the facility failed to prevent unauthorized disclosure of PHI for one patient (Patient 1) when an ED admitting clerk faxed her face sheet to an incorrect insurance company. This failure resulted in unauthorized persons having access to PHI belonging to Patient 1.Findings:During an interview with the facility CS on September 12, 2013, at 3:20 p.m., the CS stated on August 29, 2013, an ED admitting clerk faxed the face sheet for Patient 1 to an insurance company to get authorization to treat her. The CS stated the clerk faxed the face sheet to the wrong insurance company, one that had a name similar to the correct company.The face sheet for Patient 1 was reviewed on October 15, 2013. The face sheet included the following PHI:1. Name;2. Address;3. Phone #;4. DOB;5. Age;6. Sex;7. Marital status;8. MRN;9. Account#;10. Date of service;11. Diagnosis; and,12. Spouse's name, address, and phone #.The facility policy titled, "Faxing Protected Health Information," was reviewed on October 15, 2013. The policy indicated all PHI sent by EMC should be done in a manner to protect against unauthorized disclosure of such records to third parties.
