Issue:

Based on interview, the hospital failed to protect a patient's right to confidential medical information resulting in his information given to another patient. Findings:On 8/16/12 at 2:30 p.m., an interview with the privacy officer revealed Patient 1 was discharged from the Emergency Department (ED) on 6/7/12. Along with his discharge paperwork was a prescription for Phenergan 25 milligrams (an anti-nausea) tablet that belonged to Patient 2. Both Patients 1 and 2 had a prescription for Phenergan and were discharged from the ED around the same time. When Patient 1 brought the prescription to a local pharmacy to be filled, the pharmacist discovered the incorrect patient name and notified the hospital of the error.The information disclosed included the patient's name, drug name, medical record number, the physician's name, and the hospital name.
