Issue:
Based on interview and record review, the facility failed to ensure Patient A's private health information was protected from misuse by unauthorized entities, when the information was inadvertently released to an unintended recipient. This failure to ensure Patient A's information was kept private, put Patient A's protected health information (PHI) at risk for misuse. Findings:During an interview with the Director of Accreditation (DAC), the Compliance Project Manager (CPM), and the Admitting Supervisor (AS) on August 5, 2014, at 9:45 a.m., the CPM stated an admitting packet that contained copies of Patient A's License, social security card, Insurance card and an eligibility printout was inadvertently given to Patient B. The AS stated Staff 1 was working on eligibility information for Patient A, when Patient B arrived. Staff 1 placed Patient A's information to the side, and continued working with Patient B. Staff 1 printed Patient B's information then gave that information along with Patient A's information to Patient B. The AS stated Patient B returned the information to the facility on July 17, 2014. A copy of the letter sent to Patient A was reviewed on August 5, 2014. The letter indicated, "Documents containing your protected health information were inadvertently provided to another patient...The following information was available for viewing: Your name, patient ID (identification number), address, date of birth, a copy of your driver's license and a copy of your Medicare Insurance card." A review of the facility policy, "Mitigation of Impermissible Uses and Disclosures of Protected Health Information (Revision Effective: September 23, 2013)," was conducted. The policy indicated, "(the facility) must take action to reduce or eliminate, to the extent feasible, any known compromise caused by an impermissible use or disclosure of Protected Health Information..."
