Issue:
Based on interview and record review, the facility failed to ensure Patient A's protected health information (PHI) was not transcribed in Patient B's report. The report containing Patient A's PHI was faxed to an acute hospital. This failure resulted in the unauthorized disclosure of Patient A's PHI, which created the potential for unauthorized use.Findings:On July 10, 2012, at 2 p.m., an unannounced visit was made to the facility to investigate a breach of Patient A's PHI.On July 10, 2012, at 2:15 p.m., the Director of Compliance was interviewed. The Director stated on June 21, 2012, a report was faxed to the acute hospital, containing Patient A's date of birth, medical record number, and full name. The staff at the physician's office contacted the facility to notify the facility of the trascription error. On July 10. 2012, the facility policy and procedure titled, "Transcription - Operative Report," was reviewed. The policy indicated, "...Transcriptionists transcribe operative dictation with accuracy..."
