Issue:

Today, February 6, 2014, the Privacy Officer, Nashville Campus, was contacted by a Physicians Office, Vanderbilt University Medical Center (VUMC), regarding the following incident: A Physician, VUMC, found two compact discs in a VUMC multi-purpose conference room (Conference Room C, Preston Research Building) which contained a Veterans name and PET scan images. The Privacy Officer (PO), Nashville Campus, located the Veteran in CPRS and confirmed: The Veteran is enrolled in the Nashville Early Diagnosis Lung Cancer Project The Veteran was recently fee-based to VUMC for radiation The Physicians Office, VUMC, will return the compact discs to the Privacy Officer (PO), Nashville Campus, via mail. Upon investigation, the PO learned: Any images required for fee-based care are provided by TVHS Radiology Service via a compact disc. TVHS Radiology Service does not track disclosures to VUMC for treatment purposes. This Veteran is not scheduled to see VUMC Radiation until February 14, 2014 so it is unlikely their physician was in possession of the compact discs. Per the Study Coordinator, Nashville Early Diagnosis Lung Cancer Project, the research team generally views images on-site at TVHS. However, since the compact discs were located in the research building at VUMC, the Study Coordinator will ask the other team members if they were in possession of the compact discs. PO will continue to investigate until closure.

Outcome:

02/27/14: One Veteran will be sent a letter offering credit protection services.
