Issue:
During an interview on 12/9/13 at 2:00 PM, the hospital's Privacy Officer (PO) stated she had made two attempts to contact Patient 1 by telephone but was unable to locate him at either phone number. The PO stated that she had also sent two letters to Patient 1 to notify him of the breach, one letter certified and one by regular mail. Neither letter was returned and there was no response from Patient 1.The hospital made good faith efforts to contact Patient 1. Therefore, there was no deficiency identified with the notification of Patient 1 that his picture had been posted on a Facebook account without his authorization.
