Issue:

Based on interview and document review, the hospital failed to prevent unauthorized access to one patient's protected health information (PHI).Findings:In interview on 2/28/12 AT 1:30 P.M., Staff A stated that on 11/17/11, he was notified that on 11/15/11, Physician B had forwarded Patient 1's operative report to a hemodialysis unit. The dialysis unit returned the fax with a note stating that Patient 1 was not a patient at the clinic. Staff A stated that he notified Physician B of the error. Staff A stated that he had been unable to determine whether the dialysis unit had destroyed the original fax.Record review on 2/28/12 demonstrated that Patient 1's breached personal health information consisted of age, sex, medical record number, medical history, description of procedure, surgeon, and attending physician.Record review on 2/28/12 confirmed that the Department was notified of the breach on 11/17/11 and Patient 1 was notified on 11/18/11, within 5 business days of the event.
