Issue:

Based on interview and record review, the hospital failed to provide confidential medical treatment for one of one sampled patient (1). Findings:Patient 1 was admitted to the hospital on 1/4/12 with a diagnoses including labor. During an interview on 3/30/12 at 10:45 a.m. it was stated by the privacy and compliance officer that during a random audit the hospital identified three hospital employees accessed Patient 1's medical record without a business related reason. The privacy and compliance officer further stated that an internal investigation identified the employees who accessed Patient 1's medical record were the patient's friends and co-workers and just wanted to know the patient room number so as to visit her. Review of the audit form on 3/30/12 at 11 a.m. indicated employee 1 had accessed Patient 1's medical record on 1/5/12. The information disclosed to employee 1 included Patient 1's medical record number, date of birth, gender, and medical information. Employee 2 accessed Patient 1's medial record twice on 1/4/12. Information disclosed to employee 2 included the patient's medical record number, date of birth, gender, and medical information. Further review of the audit form indicated employee 3 had accessed Patient 1's medical record on 1/4/12. Information disclosed to employee 3 included Patient 1's medical record number, date of birth, and gender.
