Issue:

Based on interview and record review, the facility failed to ensure protected health information (PHI) for Patient A was sent home with the correct patient. This failed practice resulted in a breach of PHI to an unintended repicient.Findings:On March 15, 2013, at 11:20 a.m., an unannounced visit was made to the facility to investigate a breach of PHI.In a concurrent interview with the Director of Compliance, she stated a two page transition document for Patient A was sent home with Patient B. She stated the document contained Patient A's name, date of birth, age, medical record number, and internal account number. The Director stated Patient B returned Patient A's information.On March 15, 2012, the facility policy and procedure titled, "Information Privacy, was reviewed. The policy indicated, "Pursuant to the Health Insurance Portability and Accountability Act,...and California Privacy Laws, Eisenhower Medical Center will take all necessary steps to avoid unauthorized or unlawful access, use or disclosure of protected health information and to mitigate any harmful effect...
