Issue:

Veteran A states he had a C&P exam on September 13, 2014. The Dr. came to the waiting room to escort him to the examination room. When they got to the Dr.'s office the door was shut and locked. The Dr. tried to open the door and then knocked on it. A little girl (between the ages of 5 and 8) opened the door from the inside. The Veteran believed the girl to be the Dr.'s daughter. The girl went into the office next door through a door that adjoined the two offices. Veteran S states the door was cracked during the entire exam. The Veteran is unsure how many children were in the next office, but believes there was more than one because he heard them talking. Veteran A expressed that he was not comfortable during the exam, because the Dr. asked him to disclose information about a military sexual assault and death he witnessed during active duty. At one point, the provider allegedly asked him stop being so vague. Veteran A told the Dr. it bothered him to give graphic details because there were children in the next room. Veteran A reasoned that if he could hear them, they could hear him and he did not feel these details were appropriate for children to hear. Besides feeling his auditory privacy was violated, he is concerned about the VA employee leaving his and other Veteran information unsecured unattended with children.

Outcome:

09/22/14: The C&P clerk confirmed the doctors child and babysitter were in room 144-B while the doctor performed Veteran As C&P examination in room 144-A. The rooms have an adjoining interior door. It was further determined that a total of seven examinations were performed on that date by the doctor with the child and babysitter on-site. The Incident Resolution Service Team has determined that seven Veterans will be sent a HIPAA notification letter due to Protected Health Information (PHI) being disclosed.
