Issue:

Based on staff interview, clinical record, and administrative document review the facility failed to keep Protected Health Information (PHI) confidential when Patient 1's PHI was accessed inappropriately by his stepmother who is also an employee of the facility.Findings :1. On 5/13/14 at 8:45 a.m., during interview, the Privacy Officer (PO) stated that on 12/08/12, Patient 1's step mother, who was also am employee of the facility inappropriately accessed Patient 1's PHI.2. On 5/13/14 at 0845 a.m., PO stated the information disclosed was Patient 1's name, address, date of birth, gender, phone number, medical record number, account number, insurance information, and clinical information related to his hospitalization.3. On 5/13/14 the facilities policy and procedure number 12136 titled "HIPPA General Rules for the Use and Discloser of PHI" contain the following information: "CMC [Community Medical Centers] and its workforce members must comply with a number of state and federal laws and regulations. It is the responsibility of CMC management to develop and distribute necessary privacy and security policies and procedures to guide the actions of the workforce. It is also the responsibility of the CMC workforce members to comply with the policies and procedures and to cooperate with CMC management to identify and correct problems that may cause privacy or security breaches."
