Issue:

Based on staff interview, administrative document and police report review, the hospital failed to prevent unlawful access of Protected Heatlh Information (PHI) when Employee (E) 1 accessed without authorization 385 patient records (Patients 1 , 2, 3 ...383, 384, 385). This failure resulted in the malicious intent to use the stolen identities of 385 patients. Findings: On 10/22/13 the hospital self-reported an alleged incident where six patient names were accessed without a business need to know by E 1. The patient names had the same last name and the same first name, but with different dates of birth and different medical records.
