Issue:

Based on staff interview , facility and administrative document review the facility failed to keep Protected Health Information (PHI) confidential when Patient 1's PHI was mistakenly faxed to an unauthorized outside facility. This failure placed Patient 1's PHI at a risk for unauthorized use.FINDINGS:ON 6/2/14 at 9:12 a.m., during an interview, Staff 1 (Quality Manager) stated on 10/17/12 Staff 1(Licensed Nurse) mistakenly faxed Patient 1's progress note to an unauthorized facility along with Patient 2's transfer information. Staff 1 stated that the transfer information contained Patient 1's name, date of birth, age, physician name, medical record number, account number, diagnosis and treatment plan.On 6/2/14 the facility's policy and procedure number 1.0.0, titled "Privacy Policy Overview" contained the following documentation: "Privacy Policies and Procedures have been established to outline directives related to the Protective Health Information (PHI) of Patients. The directives include: Protecting the privacy of the PHI of Patients in accordance with California and federal requirements. ...Affording Patients their rights with respect to their PHI in accordance with California and federal requirements."
