Issue:

Today, 10/03/13, an employee reports that 2 other staff at the facility accessed his electronic medical record without his permission or job functions. The employee had received a Sensitive Patient Access Report (SPAR), by request. The 2 other staff members are in the same service line. The employee did not obtain medical care or services related to access by these staff, by his report. The identified complaint involves staff access once in 2010; the other access appears 3 times on 3 different dates during 1st Quarter FY13. Additional notification and investigation, to ensue.

Outcome:

11/13/13: Supervisor provided reports for both staff members. Supervisor provided an analysis of prospective actions which varied from other actions previously occurring in this service line. Chief reviewing SPAR actions for this and other SPARs requested tomorrow. 11/14/13: Discussed with Chief who agreed that appropriate disciplinary measures for staff who accessed chart without permission should be aligned with other similar cases. He will review and get back to PO about management decisions to write closure letter to Veteran. 12/02/13: The employee will receive a letter of notification.
