The above statute was NOT MET as evidenced by:Based on interview and record review, the hospital failed to ensure a patient's private health information was protected.Findings:On 9/17/10, the hospital notified the Department of a breach of a patient's private health information.On 1/19/12 at 1310 hours, an interview with the hospital's Regulatory Manager and review of the hospital and patient records showed on 9/11/10, the parent's of Patient A shared a concern with the hospital Administrative Representative that a family member of an employee had shared health information regarding their child's surgery at a local sporting event. An interview was conducted by a hospital human resources with the employee who acknowledged sharing the information with their family. The employee had received HIPPA training and signed a confidentiality agreement prior to the event.
