Issue:

While conducting an authorization/third party request audit, the Privacy Office discovered a request from a record retrieval service (on behalf of an insurance company) with an electronic signature for Veteran A. The request was processed by the Release of Information Office and Veteran A's medical records were released on 1/8/14.

Outcome:

09/15/14: The authorization had an electronic signature for Veteran A instead of Veteran A's wet signature. Electronic signatures are not valid. Wet signatures required to authenticate signature authority for the disclosure. The Incident Resolution Service Team determined that the Veteran will receive a HIPAA letter of notification.
