Issue:
Based on documentation and interview, hospital staff failed to implement a patient's right to confidential treatment of records regarding their stay in the hospital for one sampled patient (A).Findings:In an interview with administration conducted on 7/31/12, the hospital utilizes a computerized medical record for its patients. Inappropriate use of this system can be monitored by the hospital technology staff. On 5/3/12 the hospital was informed by an anonymous source, the medical record of Patient A may have been inappropriately accessed by a staff member (RN 1). This allegation prompted an immediate investigation by the hospital privacy officer.On 7/31/12 the hospital investigation report was reviewed. The report indicated for reasons unrelated to RN 1's employment, she accessed the computerized record of Patient A on 2/10 to 2/16/12 and 3/1/12, 4/6, 8, 19 and 22/12. Further review indicated RN 1 viewed the patient's entire record and there was no clinical reason for RN 1 to be viewing the record.
