Issue:

Based on interview and record review, the facility failed to ensure the PHI (protected health information) of Patient A remained confidential. This failure resulted in the unauthorized disclosure of Patient A's PHI to an unauthorized party.Findings:An interview was conducted with the facility's Privacy Officer on September 25, 2014, at 9:15 a.m. The Privacy Officer stated a Radiology Technician faxed Patient A's radiology report, intended for a physician to a private party.A review of Patient A's PHI was conducted. The document reflected Patient A's name, date of birth, medical record number, medical history, description of the radiology examination performed, and a detailed interpretation of the results.A review of the facility policy and procedure, "Faxing Protected Health Information (Last Reviewed 03/21/2013)" was conducted. The policy indicated, All Protected Health Information sent or received by (the facility) shall be in a manner that protects against unauthorized disclosure of such records to third parties. Whenever it is necessary to fax Protected Health Information, staff must comply with the procedures set forth in this policy,"The procedure indicated, "Whenever possible, staff faxing Protected Health Information shall: Telephone the receiving facility to inform them that Protected Health Information is being faxed, confirm the fax number, and determine whether the fax machine is located in a secured area...Reconfirm the destination fax number prior to transmission by calling the intended recipient or by checking the fax transmittal report, if available."
