Issue:

Based on interview and medical record review the hospital failed to prevent unauthorized access of Patient A's medical information. Patient A's protected health information (PHI) was provided by a physician to a media service through e-mail as a possible case for presentation on a upcoming television program without the permission of the patient.Findings:The Department was notified by the hospital on 3/28/12, a breach of a patient's PHI had occurred on 3/26/12.On 5/8/12 at 0910 hours, an interview was conducted with the hospital's Compliance Officer. The Compliance Officer stated a breach of PHI was discovered on 3/26/12. A nurse from the Emergency Department heard a phone message left by a producer from a television program requesting contact information for Patient A. Documents dated 3/9/12 at 1519 hours, showed Physician X disclosed Patient A's PHI to a unauthorized person through an e-mail.
