Issue:

Based on interview and record review, the facility failed to prevent the unauthorized access and/or disclosure of Patient B's medical/private information.This failure had the potential to result in the misuse of Patient B's medical/private information.Findings:On January 23, 2014, at 2:55 p.m., a phone conversation was conducted for an entity reported incident. In a concurrent interview with the Compliance Specialist (CS), the CS stated on December 23, 2013, the facility was informed by the admitting staff, during the admitting procedure Patient A was registered under the name of Patient B.The CS stated this procedure caused a patient arm band and admission documents to be generated for Patient A with Patient B's date of birth, medical record number, and account number.The CS stated the facility's practice of double checking documents prior to disclosure was not followed.The facility policy and procedure titled "HIPPA- Use and Disclosure of Protected Health Information undated, indicated "It is the policy of ...(facility's name) that the confidentiality of Protected Health information in records and collected...will be protected to the fullest extent possible."The facility indicated, "To protect the patient's right to privacy and confidentiality, at no time will names or information be shared with any person who does not have the need to know in order to provide patient care."
