Issue:

A VA employee discovered a file folder lying on the floor in the handicapped stall of the patient/public female restroom located in the Specialty Clinic. A cursory glance through the folder identified the folder belonged to a VA employee who had been in a meeting earlier; however, had left the facility for the day. The file folder was found closed with all of its contents contained within the folder. It was determined the folder had been unsecured in the public restroom less than thirty (30) minutes. The folder contained the first/last name, last four digits of the social security number of thirty (30) Veterans, to include a diagnosis for nine (9) of the thirty (30) Veterans. The file folder also contained the name, home address, social security number, date of birth, TSP account information, and checking account number of the file folder owner (VA employee) to include their Spouse's name and full social security number.A fact-finding investigation has been initiated. Update: 04/04/13:HIPAA notification letters will be sent to 30 Veterans.

Outcome:

Service chief validated the employee is required to retake the annual Privacy and HIPAA Training and Records management Training courses.
