Issue:

Based on staff interview, clinical record, and administrative document review, the facility failed to keep Protected Health Information (PHI) confidential when :1. Patient 1's prescription was inadvertently given to another Patient.2. Patient 2's PHI was given to an unauthorized payer.These failures caused the breach of Patient 1 and Patient 2's PHI and the potential for unauthorized use.FINDINGS:Refer to CAOO3881861. On 7/25/14 at 9:45 a.m., during interview, the Privacy Officer (PO) stated on 4/25/14 Patient 1's proscription was given to Patient 2 by mistake. Patient 2's pharmacy destroyed the proscription and the correct proscription was called in for Patient 2.On 7/25/14 at 9:50 a.m., Staff 1 stated the proscription contained Patient 1's name, date of birth, and name of medications.The facility policy and procedure titled "Confidentiality/Breach of Information" dated 08/16/2013 indicated "It is CMC [Community Medical Center] policy to protect the privacy and security of all patients, ... and comply with applicable State and Federal laws and regulations. The facility may only use or disclose PHI when the patient has given authorization."Refer to CA00387952On 7/25/14 at 10:00 a.m., during an interview, the Privacy Officer stated on 2/6/14 at 9:20 a.m., Patient 3's PHI was disclosed to an inappropriate payer. The claim was retrieved later and coverage was updated.On 7/25/14, Patient 3's clinical record was reviewed. Patient 3's clinical record contained name, date of birth, gender, address, medical record number, account number and electrocardiogram (EKG) results.The facility policy and procedure titled "Confidentiality/Breach of Information" dated 08/16/2013 indicated "It is CMC [Community Medical Center] policy to protect the privacy and security of all patients, ... and comply with applicable State and Federal laws and regulations. The facility may only use or disclose PHI when the patient has given authorization."
