Issue:
Based on interview and record review the facility failed to ensure that the correct X-ray report on CD was given to Patient A upon discharge from the emergency room (ER). This resulted in Patient A receiving Patient B's report causing a breach of private health information (PHI).FindingsOn 5/30/12 at 3:15 PM, the privacy officer was contacted regarding an entity report of an X-ray CD containing information for Patient B being inadvertently given to Patient A upon discharge from the ER.On 5/31/2 at 2:15 PM a review of the front of the CD sent from the radiology department showed one labeled for Patient A dated 5/17/12, and included his name, ID number and listed the exam as "hand complete". A review of the front of the CD for Patient B dated 5/17/12 included her name, ID number and listed the exam as "spine, lumbar 2 or 3 views".During a phone interview with the privacy officer on 5/31/12 at 9:00 AM, he stated, "The radiology department was processing all the X-rays and they put the CD into the wrong slip cover. The outside of the slipcover was labeled for Patient A, but inside was the CD for Patient B. Patient A found this and returned it to our facility an obtained his correct X-ray report".A review of the letter sent to Patient B by the facility to inform her of the incident acknowledged that a breach had occurred.
