VA Employee A found a document left on a printer for Employee B. It was the performance appraisal for Employee B.The performance appraisal is not protected under Privacy Act or considered PHI, however, OPM rules govern disclosure of employee performance ratings. Employee B came to Privacy Officer with the issue. Update: 04/02/12:The employee will receive a general notification letter. The information disclosed does not meet the requirements for HIPAA notification or credit protection services.
