Issue:

Based on interview and record review, the facility failed to ensure the PHI (protected health information) of Patient B remained confidential. This failure resulted in the unauthorized disclosure of Patient B's name, date of birth, address and beneficiary identification to Patient A.Findings:An interview was conducted with the facility's Privacy Officer on August 22, 2013, at 12:30 p.m., who stated Patient A received an eligibility letter meant for Patient B, which included Patient B's PHI.A review of Patient B's PHI was conducted. The document reflected Patient B's name, date of birth, address and beneficiary identification.A review of the facility's policy, "Breach of Patient Privacy: Reporting Requirements (Effective date: 09/23/09)," indicated, "Breach: the unauthorized acquisition, access, use, or disclosure of patient protected health information (PHI) that compromises the security or privacy of the PHI."
