Issue:
Based on interview and record review, the hospital failed to inform one sampled patient (1) within five business days after becoming aware of an unauthorized breach of patient medical information. Findings: On 12/17/12 at 8:00 a.m., an interview and review of the hospitals investigation were conducted with the director of risk management. She stated, on 9/24/12 at 8:00 p.m., a hospital staff member (ST 1) notified the risk department by telephone regarding a patient privacy breach.The director of risk management stated she notified the California Department of Public Health (CDPH) on 9/27/12 and mailed a notification letter to Patient 1's address on 10/9/12. During an interview with ST 1 on 12/17/12 at 8:45 a.m., she stated, in the course of a telephone conversation, she identified a patient by name and shared specific medical treatment concerns with an ex-employee of the hospital.
