Issue:
An Institutional Review Board (IRB) discovered a Primary Investigator (PI) extracted data on more patients than approved by the IRB. The PI had a HIPAA Waiver to collect a specific amount of data, but pulled data that exceeded the approved amount without submitting a Modification to the approved study. The IRB will be providing the Privacy Officer (PO) with details. The information was internal. The PI is a VA employee.
Outcome:
03/19/15: The Incident Resolution Service Team has determined that this is a privacy violation, but not a data breach, as the information never left VA control.
