Issue:

Based on interview and record review, the facility failed to ensure the protected health information (PHI) of Patient A remained confidential. This failure led to the unauthorized disclosure of Patient A's PHI to Patient B's family member, who was not authorized to receive the information.Findings:An interview was conducted with the Admitting Supervisor on January 16, 2014, at 4 p.m. The Admitting Supervisor stated the newborn packet meant for Patient A was inadvertently given to Patient B's family member.A review of Patient A's newborn packet was conducted. The packet reflected Patient A's name, date and time of birth, and the names of Patient A's family members, in addition to their dates of birth.A review of the facility policy, "Mitigation of Impermissible Uses and Disclosures of Protected Health Information (Revision Effective: September 23, 2013)," was conducted. The policy indicated, "(the facility) must take action to reduce or eliminate, to the extent feasible, any known compromise caused by an impermissible use or disclosure of Protected Health Information..."
