Issue:

The facility Information Security Officer (ISO) ran a daily audit report and discovered that a VA employee, who is the wife of Veteran A, accessed his medical records Update: 10/19/11:The employee did not have authorization to access the spouse's record, therefore Veteran A will receive a notification letter.11/01/11:An appeal was filed. The DBCT reviewed the appeal but has additional questions for the Privacy Officer (PO). The additional questions were sent to the PO. The PO responded by rescinding his appeal request. He stated that after further review, he agreed that the spouse should be notified. The notification letter was sent on 10/27/11.

Outcome:

The Privacy Officer (PO) will discuss this incident with wife (employee) and she will have to review and re-sign the Rules of Behavior. PO sent out a notification letter to the spouse on 10/27/11.
