Issue:
Based on interview and record review, the facility failed to ensure Protected Health Information (PHI), for Patient A, was not faxed to an unintended recipient. This failed practice resulted in the disclosure of PHI to unintended recipients.Findings: On August 30, 2011, at 10:45 a.m., an unannounced visit was made to the facility to investigate a breach of medical information.In a concurrent interview with the Compliance Officer, she stated staff faxed documents for Patient A to an unintended recipient. The documents contained Patient A's name, social security number and the results of an alcohol test.On August 30, 2011, the facility policy and procedure titled, "Faxing Protected Health Information," was reviewed. The policy revealed, "...Policy: All Protected Health Information sent or received by EMC shall be in a manner that protects against unauthorized disclosure of such records to third parties...It shall be the responsibility of all EMC staff to ensure compliance with the policies and procedures established in this document..."
