Issue:

Based on interview and record review, the facility failed to ensure the protected health information (PHI) of Patient A remained confidential. This failure resulted in the unauthorized disclosure of Patient A's PHI by a family member employed at the facility.Findings:An interview was conducted with the Privacy Officer (PO) on December 30, 2013, at 10:45 a.m. The PO stated on November 19, 20, and 22, 2013, a Staff Employee, who was currently employed at the facility accessed the PHI of Patient A, a family member.A review of Patient A's PHI which was accessed was conducted with the PO. The PO stated the PHI reflected Patient A's name, medical record number, and the result of laboratory studies.A review of the facility policy, "Patient Privacy, Confidentiality, Medical Records, And Access To, Or Release Or Disclosure Of, Patient Information, (Revised Date: 01/02/09)," indicated, "(The facility) and its personnel shall reasonably safeguard confidential medical information from any unauthorized access or unlawful access use, or disclosure."
