Issue:
A Veteran called to complain that his employer was sent a copy of his ER visit. The Veteran stated he had asked for a note that he was in the ER only but the employer received the records. In reviewing, Release of Information (ROI) had released his ER visit to his employer. ROI had a written request from the Veteran that did state to release any and all information regarding his visit to be faxed to his employer. The request was not HIPAA compliant and no records should have been released.
Outcome:
12/04/13: The Veteran will receive HIPAA letter of notification.
