Issue:

Based on interview and record review, the facility failed to ensure the PHI (protected health information) of Patient A remained confidential. This failure resulted in the unauthorized disclosure of Patient A's PHI to Patient B.Findings:An interview was conducted with the Deputy Information Privacy Officer (DIPO) on June 22, 2015, at 9 a.m. The DIPO stated on June 8, 2015, Patient B was at one of the facility's clinics for treatment and was given a laboratory slip meant for Patient A.The DIPO further stated Patient B notified the facility on June 9, 2015, via their health message computer system that he was in possession of Patient A's laboratory (lab) slip.A review of Patient A's lab slip was conducted on June 22, 2015. The PHI on the lab slip reflected Patient A's name, date of birth, address, diagnosis, and the three lab tests ordered by the patient's physician. A review of the facility policy, "HIPAA - Use and Disclosure of Protected Health Information (Last Reviewed/Revised 2/10/15)" was conducted. The policy indicated," To protect the patient's right to privacy and confidentiality, at no time will names or information be shared with any person who does not have a need to know in order to provide patient care."
