Issue:

Based on interview and record review, the facility failed to ensure the PHI (protected health information) of Patient A remained confidential. This failure resulted in the disclosure of Patient A's PHI to an unauthorized recipient.Findings:An interview was conducted with the facility's HIPAA (Health Information Portability and Accountability Act) Manager (HIM) on August 13, 2014, at 11:15 a.m. The HIM stated a patient requested two cardiac procedures he had done at the facility be mailed to him on compact discs (CDs). When the patient viewed the two CDs one of the CDs reflected Patient A's procedure, not the patient's procedure.The HIM further stated Patient A's PHI on the CD reflected the cardiac procedure, Patient A's name and date of birth.A review of the facility policy, "Safeguarding Protected Health Information (Effective Date: September 23, 2013)," was conducted. The policy indicated, "The facility must take reasonable steps to safeguard and protect PHI. The facility must identify and utilize appropriate administrative, physical, and technical safeguards in order to protect PHI from inappropriate and/or unauthorized access, use and/or disclosures."
