Issue:

An employee who is the ex-spouse of a Veteran/employee has accessed the Veteran employee's Veteran medical record on several occasions in the last year. We do not know whether the access was in the performance of the employee's duties at this point.

Outcome:

03/16/15: PO update - The Privacy Officer (PO) has reviewed the record and found that he will need to conduct a fact finding. The PO will be contacting the Supervisor on 3/16/15 to schedule. 3/25/15: A fact finding interview was conducted on March 24, 2015, the employee admitted accessing the record and that they knew that this was not an acceptable practice. A report will be submitted to management on March 25, 2015. The Privacy Officer will be recommending that the employee review the VA Rules of Behavior. 03/26/15: The Incident Resolution Service Team has determined that Veteran A will be sent a notification letter.
