Issue:
Based on interview and record review, the hospital failed to maintain the confidentiality of medical record information on 1 of 1 sampled patient. The patient's medical record information was inadvertently sent via facsimile transmission to a clinic without the patient's authorization (Patient 1).Findings:An onsite visit of the hospital was conducted on 1/24/2012 in response to the facility's report about an incident whereby Patient 1's medical record information was inadvertently sent out via facsimile transmission to the another entity without the patient's authorization. On 1/24/12 at 3:40 P.M., an interview was conducted with the hospital data analyst (Employee 2). Based on her review of the report and confirmation with the director of quality and regulatory affairs, it was determined that the following medical record information belonging to Patient 1, was inadvertently sent out via facsimile transmission to a clinic:1. Face sheet containing the patient's demographic information such as date of birth, address, medical record number, health insurance information, and health complaints.2. Emergency Department report containing the patient's health history.3. Diagnostic procedures and test results.The inadvertent release of the above medical record information without the patient's authorization, was in violation of the patient's right to privacy and confidentiality of medical information.The California Department of Public Health (CDPH) verified that the facility had informed the patient of the incident by the time the report was made.
