Issue:
Based on interview and hospital document review, the hospital failed to prevent the unauthorized disclosure of Patient F's protected health information (PHI) to unauthorized individuals. In addition, the hospital failed to notify the patient of the breach in a timely manner after their knowledge of its occurrence.Findings:On 8/23/12 the Hospital Compliance Officer was notified a breach concerning Patient F occurred on 8/22/12.On 8/22/12, a request for release of Patient F's medical records was to be sent via fax to another acute care hospital. The fax for the request was sent; however, the fax was incorrectly sent to the wrong acute care hospital.Patient F's disclosed PHI included name, date of birth, medical record and account number, physician name, date of service and the patient's mother's name, as patient was a minor.The hospital was aware of the breach of PHI on 8/23/12. The hospital notified Patient F of the breach of PHI on 9/27/12.
