Issue:

Based on interview and record review, the facility failed to prevent unauthorized access and disclosure of Patient 65's protected, confidential health information, when the patient's identification label was applied to another patient's surgical packet. This failure allowed for potential unlawful or unauthorized use of the information and violation of the patient's right to privacy. Findings: During an interview on 1/09/14 at 11 a.m., the Compliance Officer confirmed that information included on the label and stated that staff person had picked up the wrong label when preparing the packets for the patients. The information inside the packet was correct.A review of the documents submitted by the facility revealed that the information included the patient's name, medical record number, date of birth, date of visit and the primary language spoken by the patient. The incident resulted from the staff person's failure to reconcile the correct name on all documents prior to compiling them and giving them to the patient.
