Report ID: SPE000000074299, U.S. Department of Veterans Affairs

Reported Entity: VISN 11 Detroit, MI

Issue:

On 04/03/12, the Privacy Officer (PO) received an email from the Health Resource Center (HRC). Veteran A had called the HRC to report that his medical records were released to the State of Michigan Child Protective Services without his authorization. Upon investigation and in conjunction with General Counsel, it was found that although a subpoena was provided, it was not signed by a Judge but only by the attorney and therefore was an improper release of the medical records which contained the Veteran's full name, SSN, health information (including mental health records) diagnosis etc. Update: 04/18/12:Veteran A will be sent a letter offering credit protection services.

Outcome:

PO has received final guidance from GC of the improper disclosure of this Veterans medical record. PO has been informed that employees have received disciplinary action in this issue as well as additional training. Since the medical records were released improperly, PO is suggesting that this Veteran receive credit monitoring. Copy of redacted CM letter is attached.
