Issue:
Based on interview and record review, the facility failed to prevent unauthorized access and disclosure of 8 patients' (Patients 26, 27, 28, 29, 30, 31, 32 and 33) protected, confidential health information, when a paper with these patients' names and information was found in the stairwell of the facility. This failure allowed for potential unlawful or unauthorized use of the information and violation of the patient's right to privacy.Findings: During an interview on 5/26/15 a at 13 a.m., the Compliance Coordinator confirmed that the patients' information had been found by a nurse, although the facility staff was unable to determine who had dropped it or how long it had been there. She confirmed the information that was included.Interview and review of the letter submitted by the facility revealed that the information which was given included the patients' name, age, medical record number and diagnostic information.The staff person who had lost this document had failed to secure it, prior to transporting it.
