Report ID: PSETS0000108659, U.S. Department of Veterans Affairs

Reported Entity: WESTERN NEW YORK HCS - 528A4

Issue:

Staff member (former Police Officer) reports that Police cut lock on his locker and went through his items. He had been working with Chief of Police to empty the locker this week. The locker had many personal and employee records in it. Unable to determine if items are missing.

Outcome:

09/02/14: The Privacy Officer (PO) will talk with the Police Chief. This is a former officer who just settled his Human Resources (HR) issues within the past week or so. There is a long standing history with the individuals who cut the lock. The PO opened the ticket while the former officer was in her office so that she could find out all the personal documents that he stated was in the locker that may have been copied. The PO spoke with Police chief. The staff had not been authorized to cut the lock and they did not notify anyone that that they were going to do it. The employee who's locker it was had not removed his items despite not being in the Police department for several months. The new chief felt it should have been emptied a while ago. They are working with HR on discipline. The Incident Resolution Service Team determined that the former officer will receive a HIPAA letter of notification.
