Issue:
Based on interview and record review, the facility failed to prevent improper disclosure of a patient's (Patient 1) medical information when a staff member accessed Patient 1's electronic record without a clinical need. This failure allowed for unauthorized use of the information and violation of the patient's right to privacy.Findings:During an interview on 7/8/13, at 11:30 a.m., the facility Privacy Officer confirmed that Patient 1's clinical record was accessed by three staff members (Licensed Staff A and Unlicensed Staff B and C) who had no clinical need to view this information.Review of the facility's investigation of the incident contains information confirming the staff members' access to Patient 1's clinical record. In the inquiries, Licensed Staff A and Unlicensed Staff B and C acknowledged they had viewed Patient 1's medical record without a clinical reason to do so.
