Issue:

Based on interview and record review, the facility failed to notify the California Department of Public Health (CDPH) of the breach of personal patient health information within the required five business days after the breach was detected.Findings:During an interview on 1/22/13 at 3:35 PM, Staff A stated the breach happened when a patient care manager gave a letter of counseling to a staff member who took care of Patient 1 and 2 in the intensive care unit. Staff A stated the counseling letter, which contained Patient 1 and 2's name and health information was inadvertently mailed to the California Nurses Association. She said the facility became aware of the breach on 11/6/12 and the breach was reported late because of a delay in reporting between nursing and the Privacy Officer.Review of the counseling letter dated 10/18/12 indicated Patient 1's name, age and diagnosis; and Patient 2's name, age, diagnosis, vital signs and description of his health decline in the intensive care unit.Review of the report sent to CDPH notifying them of the medical information breach indicated it was faxed on 11/21/12. The facility was 7 days late in reporting the information breach within five business days after it was detected.
