Issue:

Based on documentation and interview, hospital staff failed to implement a patient's right to confidential treatment of their medical record.Findings:In an interview conducted with the hospital privacy officer on 8/21/12, a medical patient (Patient 1) was given another patient's (Patient 2) discharge/transfer information. According to documentation in a hospital's investigation report that was reviewed the same day, on 6/12/12 Patient 1 requested a copy of his medical record. The record was given to him at the nurses station in a binder labeled "My Health Instructions." The patient left with the binder but returned shortly, stating the binder contained records for another patient (Patient 2). The hospital privacy officer was informed of the error and an immediate investigation was conducted. The privacy officer stated the information provided to Patient 1 included Patient 2's name, transfer summary, medical record number and course of care.
