Issue:

It was reported that a Nursing Assistant violated a patients privacy by reviewing the medical record of her neighbors chart. The Privacy Officer (PO)was unable to confirm the date of access of this incident as the Manager was out of the office today. The PO will get the issue brief tomorrow. The Nursing Assistant had no reason to access this record and the patient was not admitted to Nursing Assistant's floor at the time. Update: 12/12/12:The Patient will be sent a notification letter.

Outcome:

The Service may review disciplinary action with HR once PO has completed the investigation. The employee has been verbally educated to the minimum necessary standard, retaken the Privacy & HIPAA training and forwarded certificates to the PO.
