Issue:
Based on interview and record review, the facility failed to ensure the PHI (protected health information) of Patient A remained confidential. This failure resulted in the unauthorized disclosure of Patient A's PHI to an unintended recipient, Patient B.Findings:An interview was conducted with the facility's Director of Accreditation (DAC) on July 10, 2014, at 1:50 p.m. The DAC stated Patient B had a radiology test conducted on May 30, 2014. The facility mailed PHI to Patient B which also contained a report that reflected PHI for Patient A. Patient B subsequently returned Patient A's PHI to the facility's offices. A review of Patient A's PHI which was given to Patient B was conducted. The PHI reflected Patient A's Name, age, medical record number, clinical history and information related to a radiology scan. A review of the facility policy, "Protected Health Information Process For Distributing documents (Effective Date 4/20/2014)." The purpose of the policy was "Highlight Medical Record Number and first and last name of member on each page. To ensure patient confidentiality and protect the organization by confirming that documents containing Protected Health Information are given to the correct member or caregiver." The procedure indicates, "Ask the member...to state their name. Put your initials on the first page of the document given to the member or caregiver, Review documents with the member or caregiver."
