Issue:

Veteran A, who was enrolled at our facility, was hospitalized and discharged 2 days later for a condition falling within purview of 7332 criteria. A follow-up call was placed to Veteran A's residence but the Veteran did not take the call. The spouse did take the call and follow-up instructions. The issues surrounding the follow-up call fall within the purview of 7332 and thus required consent on the part of the Veteran in order for the spouse of the Veteran to receive follow-up instructions. The Veteran was contacted by telephone and conveyed the spouse had in fact received a call and the follow-up information and the Veteran had not granted prior information relating to 7332 information to be released to the spouse. The Veteran could not provide the name of person making the follow-up call nor could the spouse.

Outcome:

06/06/14: The Incident Resolution Team has determined that Veteran B will be sent a HIPAA notification letter due to Protected Health Information (PHI) being disclosed.
