Issue:

Based on interview and review of hospital documents, the hospital failed to prevent the disclosure of Patient I's protected health information (PHI) to unauthorized individuals. In addition, the hospital failed to report the disclosure of PHI to Patient I within five business days of the breach being discovered.Findings:The hospital discovered a breach of Patient I's PHI occurred on 12/9/10. Review of the hospital's investigation showed a patient discharged from the Emergency Department was given a copy of Patient I's ultrasound report in error. The PHI on the ultrasound report included Patient I's name, medical record number, date the ultrasound was conducted, ordering physician, reason for the exam and the results of the ultrasound.The breach of PHI was discovered by the hospital on 12/9/10. The hospital did not notify Patient I of the breach until 12/20/10. On 4/6/12 at 0930 hours, during a telephone interview the Manager of Regulatory Compliance verified the above reported breach and the dates.
