Issue:

Release of Information received a copy of a form (Physician Verification Form, Domestic Relations Sections, In the Court of Common Pleas of Cambria County, PA) from Johnstown CBOC that was completed by a Provider. The form was not signed and dated by the patient and it contains 7332 information. The Provider gave the completed form to the CBOC MSA who called the patient to pick up. Patient did not sign the completed form. He signed a 10-5345a but did not sign a 10-5345 for the 7332 information contained in the form. The patient requested the form back to reportedly take back to the Court in which case, the contents of the document are in violation of the patients rights (because it contains 7332 documentation and the appropriate authorization was not obtained). The form was not referred to the Privacy Officer to review for FOIA considerations.

Outcome:

05/06/14: The Incident Resolution Team has determined that the Veteran will be sent a HIPAA notification letter due to Protected Health Information (PHI) being disclosed.
