Issue:
Based on interview and record review, the facility failed to prevent unauthorized disclosure of medical information for one patient (Patient 1) when progress notes written by a physician at the cancer center were faxed to a private business instead of another physician. This failed practice resulted in the potential for emotional harm to Patient 1.Findings:During an interview with the facility privacy officer (PO) on August 14, 2014, at 11:10 a.m., the PO stated Patient 1 was seen in the facility's cancer center, and when the notes written by the physician from the cancer center were being faxed to another physician, they were faxed to a private business instead. The PO stated the staff at the cancer center faxed the progress notes to the wrong number. A review of the progress notes that were faxed to a private business indicated they contained the following medical information:1. History/description of his present illness;2. Allergies;3. Medications;4. Past medical history for Patient 1 and his family;5. Surgical history;6. Physical examination;7. Analysis of findings; and,8. Plan for further treatment.Failure to verify the progress notes were being faxed to the correct number resulted in unauthorized persons having access to medical information for Patient 1.
